SparkyMag Limited Warranty

SparkyMag warrants to the original purchaser (“Purchaser”) that all electrical products and items sold on our website will be free from material defects in workmanship and materials under normal use and service conditions.

• Standard Warranty: All products come with a 1- to 2-year warranty, regardless of residential or commercial use.
• Extended Warranty: If the product is manufactured by SparkyMag, an extended warranty of 2 years for residential use and 1 years for commercial use may apply.
• Third-Party Products: If the product is not manufactured by SparkyMag but is only resold through our website, the warranty duration and coverage will be subject to the original manufacturer’s warranty.

This warranty covers failures due to defects in materials or workmanship but does not apply to damage caused by improper installation, misuse, neglect, or external factors beyond our control.

For the purposes of this warranty:

• Residential use refers to products installed or used in private homes.
• Commercial use refers to products installed or used in businesses, offices, or other non-residential settings.

This warranty is subject to the exclusions, limitations, and conditions outlined below.

Exclusions from Warranty Coverage

SparkyMag does not warrant and is not responsible for any product failure, malfunction, or damages arising from:

a) Improper Installation – Failure to follow SparkyMag installation guidelines, including but not limited to incorrect spacing or gapping.

b) Misuse or Unauthorized Applications – Using the product beyond normal use or in applications not recommended by SparkyMag guidelines or local building codes.

c) Structural Issues – Movement, distortion, collapse, or settling of the ground or the supporting structure on which the product is installed.

d) External and Environmental Factors – Damage caused by acts of God (e.g., floods, hurricanes, earthquakes, lightning), environmental conditions (e.g., air pollution, mold, mildew), or staining from foreign substances (e.g., dirt, grease, oil).

e) Color Variations – Changes or variations in product color over time.

f) Normal Weathering – Exposure to sunlight, weather, and atmospheric conditions that may cause surfaces to flake, chalk, fade, or accumulate dirt/stains.

g) Incorrect Installation by Third Parties – Damage or defects resulting from improper installation, particularly when installation was not purchased through sparkymag.uk but performed by another company or the buyer.

h) Improper Handling or Storage – Damage due to mishandling, poor storage, abuse, or neglect by the purchaser or third parties. The purchaser is solely responsible for determining the effectiveness, fitness, suitability, and safety of the product for a particular application.

i) Ordinary Wear and Tear – Natural degradation over time due to regular use.

Transfer of Warranty

• Residential Applications: This warranty may be transferred once within two (2) years from the original purchase date to a subsequent buyer of the property where the product was installed.
• Commercial Applications: The warranty is freely transferable to any subsequent buyer of the property where the product was installed.

Disclaimer of Warranties:

Except for the express written warranty contained herein, SparkyMag makes no other warranties, guarantees, or indemnities, whether express or implied, arising by law, course of dealings, usage of trade, customer, or otherwise, including but not limited to the implied warranty of merchantability and implied warranty of fitness for a particular purpose, and all such other warranties, guarantees and indemnities are hereby disclaimed, overridden and excluded from this transaction. Limitation of remedies and exclusion of consequential and incidental damages: SparkyMag liabilities are limited solely and exclusively to the obligations specifically undertaken herein, and under no circumstances will SparkyMag be liable or obligated for any incidental consequential, indirect, special, punitive, or any other damages of any kind whatsoever (including, but not limited to, lost profits, lost sales, loss of goodwill, use of money, use of goods, stoppage of work, or impairment of assets), whether foreseeable or unforeseeable, arising out of the breach of failure of express or implied warranty, breach of contract, fraud, misrepresentation, negligence, strict liability in tort or otherwise, except and only to the extent this limitation is specifically precluded by applicable law of mandatory application. SparkyMag liability concerning defective products shall in no event exceed the replacement of such products or refund of the purchase price, as described above.

This writing is understood and intended to be the final expression of the party’s agreement and is a complete and exclusive statement of the terms

This warranty may not be altered or amended except in a written instrument signed by SparkyMag and the purchaser or permitted transferee. No agent, employee, or any other party is authorized to make any warranty in addition to that made in this agreement and SparkyMag shall not be bound by any such statements.

This warranty shall only be applicable and enforceable in the United Kingdom. This warranty is effective for purchases made on or after January 1, 2022.
